The Role of the Judge
A sentencing judge generally considers numerous factors when determining punishment.
Depending on the jurisdiction, these can include the severity of the offense, the defendant’s role, criminal history, circumstances surrounding the crime, impact on victims, applicable sentencing laws, and other legally relevant factors.
In juvenile cases, age and developmental factors may also become important.
A judge’s decision isn’t simply a matter of deciding whether they personally like or dislike the defendant.
The court operates within a legal framework.
Mandatory minimums and sentencing statutes can significantly limit judicial discretion.
Why Sentencing Laws Matter
Sometimes people see an unusually long sentence and assume the judge simply chose an extreme number.
That may not be what happened.
Sentencing laws can require specific penalties for particular offenses.
When multiple convictions are involved, sentences can sometimes be added together.
